By entering into this User Agreement with RRCellars.ae, you hereby confirm your consent and acceptance to the terms and conditions below:

• Introduction

Welcome to RRCellars.ae These are the terms and conditions governing your access to and use the website RRCellars.ae and its related sub-domains, sites, services and tools (the “Site”). By accepting these terms and conditions (including the linked information herein), and by using the Site, you represent that you agree to comply with these terms and conditions with RRCellars.ae (“we”, “us” or “RRCellars.ae”) in relation to your use of the Site (the “User Agreement”). This User Agreement is effective upon acceptance. If you do not agree to be bound by this User Agreement please do not access, register with or use this Site. Before you may become or continue as a member of the Site, you must read, agree with and accept this User Agreement and the RRCellars.ae Privacy Policy (the “Privacy Policy”). You should read this User Agreement and the Privacy Policy and access and read all further linked information referred to in this User Agreement, as such information contains further terms and conditions that apply to you as a user of RRCellars.ae. Such linked information including but not limited to the Privacy Policy is hereby incorporated by reference into this User Agreement.

• Eligibility for engagement and shopping

RRCellars.ae wishes to ensure that its customers can form legally binding contracts and further that minors and ineligible persons do not have access to the Site or purchase unsuitable content. Therefore, persons and/or under the age of 21 years cannot access to or purchase from the site. Without prejudice to any other rights and remedies of RRCellars.ae under this User Agreement or at law, RRCellars.ae reserves the right to limit or withdraw access to the Site of any person if RRCellars.ae believes that person is ineligible or is under the age of 21 years or not legally allowed to consume alcohol in their country of residence.

• Your Account and Registration Obligations

When you register on the Site you have been or will be required to provide certain information and register a username (Email ID) and password for use on this Site.

On registering on the Site, you agree:

You are responsible for maintaining the confidentiality of, and restricting access to and use of, your account and password, and accept responsibility for all activities that occur under your account and password. You agree to immediately notify RRCellars.ae of any unauthorized use of your password or account or any other breach of security. In no event will RRCellars.ae be liable for any direct, indirect, or consequential loss or loss of profits, goodwill or damage whatsoever resulting from the disclosure of your username (Email ID) and/or password. You may not use another person’s account at any time, without the express permission of the account holder. You agree to indemnify and defend RRCellars.ae for any improper, unauthorized, or illegal use of your account by you or by any person obtaining access to the Site, services or otherwise by using your designated username and password, whether or not you authorized such access.

You will provide true, accurate, current, and complete information about yourself as prompted by the RRCellars.ae registration form (the “Registration Data”).

You will maintain and promptly update your Registration (Account) Data to keep it true, accurate, current, and complete all the time. If you provide any information that is untrue, inaccurate, not current or incomplete or if RRCellars.ae has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with this User Agreement, without prejudice to any other rights and remedies of RRCellars.ae under this User Agreement or at law, RRCellars.ae has the right to indefinitely suspend, limit or withdraw your access to the Site and/or your membership of the Site.

RRCellars.ae may (in its sole discretion and at any time), make any inquiries it considers necessary (whether directly or through a third party), and request that you provide it with further information or documentation, including without limitation to verify your identity and/or ownership of your financial instruments. You agree to provide any information and/or documentation to RRCellars.ae upon such requests. You acknowledge and agree that if you do not the requested documents or information within the requested timeframe, RRCellars.ae without liability may limit, suspend or withdraw your access to the Site and/or your membership of the Site. We also reserve the right to cancel unconfirmed / unverified accounts or accounts that have been inactive for over 12 months.

• Amendments to this User Agreement

You acknowledge and agree that RRCellars.ae shall endeavour to give you notice for any amendment to this User Agreement that materially increases your obligations or decreases your rights under the User Agreement (“Substantial Amendment”) in accordance with the terms of this User Agreement. You acknowledge and agree that RRCellars.ae at its sole discretion and without liability may make amendments that are not Substantial Amendments without your further specific agreement at any time with immediate effect by posting a notice of the amendment on the Site.

• Privacy Policy

At RRCellars.ae we have utmost respect for your privacy. Any data you have provided to us will not be shared with any third parties.

We will always give you the option to opt out of monthly emails, personalized offers or invitations to our events. Please refer to our full Privacy Policy.

• Protecting Your Security & Age Verification

You agree that we may use personal information provided by you in order to conduct appropriate anti-fraud checks and to confirm you are of legal age if purchasing alcohol. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

We will not sell to anyone who is below 21 years of age or ineligible, as the law requires. To ensure that your credit, debit or charge card is not being used without your consent, we may validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. Be assured that this is done only to confirm your identity, and that your credit rating will be unaffected.

• Prices

There may be instances where errors may occur in the process of providing product and pricing information on RRCellars.ae.  No cash reimbursements will be issued under any circumstances.

There will be instances where a price online does not match the price in a store. Prices and product availability are subject to change without any prior notice.

All customers will be charged in UAE Dirham and differences between approximation in any foreign currency and actual billing price on the customer’s credit card bill is probably attributable to different credit card companies charging varying exchange rates.

• Orders

When you have completed your order, you will be sent an e-mail confirming your order. It will state what the products/services are, the cost, invoice details, and the scheduled collection date. If your order has been unsuccessful, you will be made aware of the reason why and any possible explanations.

• Click & Collect

RRCellars.ae provides Click and Collect Services on the website, Once the Order has been submitted, our team will contact you as soon as its ready for collection.  If you require delivery services, please note we offer delivery in Ras Al Khaimah Only.

• Availability

If for any reason beyond our control, we are unable to supply a particular product of your order, we will notify you by SMS or email as soon as possible. If a product is unavailable, the customer will be notified prior to delivery or in store collection and where possible offered an alternative.

• Product Changes

Suppliers may change bottle type, size, vintage, and labeling at any point with no prior notice. Whilst we endeavour to ensure all images are correct and up to date on the website. We cannot guarantee the bottle type, size, vintage, and labeling when a product undergoes a change.

• Special Offers

Any special offers on RRCellars.ae are available only whilst stocks last on a first come, first served basis and may be withdrawn at any time, without notice.

• Payment Terms

To confirm and process your order on RRCellars.ae, you are required to submit your order online with your contact telephone number and email ID, our team will pack your order and contact you once your order is ready for collection.  Payment must be made during collection of goods.

• Returns & Refunds

Damaged or faulty goods – RRCellars.ae will provide a replacement on the rare occasion a breakage occurs or for products that are faulty on a case by case basis. RRCellars.ae must be notified of damaged or faulty products during collection. We may require the faulty products to be returned to us so please keep all the original packing. To process a replacement due to damage or breakage, a clear photograph(s) of the damaged goods will need to be provided. Once a replacement is approved, the customer may be required to visit RR Cellars Retail Shop to exchange the damaged goods.

• Cancellation of Services

We reserve the right to terminate the customer from using our services at any time, for whatever RRCellars.ae considers inappropriate or improper use or not abiding by these terms and conditions or if required by the law or the governing authority. You will be informed of such termination in writing.

• Social Media Policy

RRCellars.ae engages in the use social media for our customers who enjoy using these channels. Should you wish to contact us regarding any orders, or any product enquiries please contact us either via telephone, email, as there may be delays on any enquiries posted on social media, which is a marketing channel. Please note RRCellars.ae social media is monitored. Any comments or posts should be within the recommended guidelines. Any comments or posts that are deemed inappropriate, slanderous, or abusive, either directed at other customers, other social media users, RRCellars.ae and staff or agents thereof or not, will be recorded and may result in legal proceedings.

• Withdrawal of Access and/or Membership

Without prejudice to any other rights and remedies of RRCellars.ae under this User Agreement or at law or otherwise, RRCellars.ae may limit, suspend, or withdraw your access to the Site at any time, without notice, for any reason, including without limitation, breach of this User Agreement.

• No Warranty

RRCellars.ae provides the Site and its services on an “as is” and “as available” basis without any representation or endorsement made and without any warranty or guarantee of any kind whether express or implied, including but not limited to warranties of title, merchantability, fitness for a particular purpose, compatibility, security, accuracy, and non-infringement.

RRCellars.ae makes no representations or warranties about the accuracy, reliability, or completeness of any content, information, software, text, graphics, links, or communications provided on or through the use of the Site or that the operation of the Site will be error free and/or uninterrupted.

RRCellars.ae makes no warranty that defects will be corrected or that the Site or its servers are free of viruses or anything else, which may be harmful or destructive. The nature of internet communications means that this Site may be susceptible to data corruption, interception, non-availability, and delays. The Site may also be unavailable from time to time due to repairs, maintenance, or development work. You agree that RRCellars.ae has no obligation to provide support for the Site. You expressly agree that you use the Site at your own risk.

• Governing Law

This User Agreement is governed by and construed in accordance with the laws of United Arab Emirates.  This clause will survive any expiry or cancellation of this User Agreement for any reason.
